These Terms and Conditions apply to all contracts between Shellfire GmbH, Altkönigstraße 10 A, 61389 Schmitten ("Shellfire", "we") and consumers (§ 13 BGB) regarding digital VPN services and any delivered hardware ("Shellfire Box"). Conflicting or deviating conditions will not become part of the contract unless we expressly agree to their validity in text form.
1. Service. The subject matter is the provision of a virtual private network (VPN) as a digital service (§§ 327 ff. BGB) together with apps and optionally hardware.
2. Invitation to offer. Our online presentations are mere invitations to make an offer.
3. Contract formation. A contract is formed as soon as we accept your offer by activating the service or expressly (email). The order button reads "Order now with costs".
4. Minimum age 18 years. By making an offer, you confirm your legal majority (mandatory checkbox). We may request appropriate proof (e.g. eID verification, credit card check). If minority is discovered, we close the account and refund paid fees (§§ 104 ff., 109 BGB).
1. Service description. We operate a worldwide VPN server network and enable encrypted data transmissions.
2. Maintenance. We announce planned maintenance – where possible – at least 24 hours in advance.
3. Your rights in case of outages. In case of significant or repeated outages, your statutory rights under §§ 327d–327l BGB (reduction, withdrawal, damages or expense reimbursement) as well as an extraordinary right of termination apply.
4. Privacy & End Device Protection (TDDDG).
1. Keep end devices up to date (operating system and security patches).
2. Impermissible use (including crimes, spam, intellectual property violations) is prohibited. Blocking occurs only after warning and after the fruitless expiry of an appropriate period (regularly 48 hours), if reasonable. In case of final blocking, we refund proportional fees for the remaining term.
1. Prices include statutory VAT; EU-wide OSS procedure.
2. Fees are due per billing interval in advance. Permissible payment methods are displayed at checkout.
3. Price adjustments. Changes only apply after express consent. Silence does not count as consent.

For intervals > 3 months, we send reminder emails 3, 2 and 1 month before renewal (§ 312k Abs. 2 BGB).
Confirmation: We confirm every termination immediately by email.
This clause only applies if you purchase a Shellfire Box or other hardware.
The hardware remains our property until full payment (§ 449 BGB).
The rights for digital products (§§ 327 ff. BGB) apply. During the contract term, we provide all necessary security and functional updates.
Unlimited liability for intent, gross negligence, injury to life, body, health, under ProdHaftG and Art. 82 GDPR.
For property and financial damage from slight negligence, we only are liable for breach of essential contractual obligations (cardinal obligations) and limited to foreseeable, contract-typical damage.
Otherwise, liability is excluded to the extent legally permissible.
German law applies while preserving mandatory consumer protection standards of your country of residence (Art. 6 para. 2 Rome I Regulation). For actions by Shellfire against consumers, their general place of jurisdiction applies; consumers may also sue at their place of residence (Art. 18 Brussels I Regulation).

We do not participate in dispute resolution procedures before a consumer arbitration board (§ 36 VSBG).
Changes only occur for compelling reasons (e.g. legal changes) and without disadvantaging the main services.
§ 327r BGB remains unaffected.

These Terms and Conditions are available in German and English. In case of discrepancies, the version more favourable to the customer applies.
Should a provision of these Terms and Conditions be invalid, the contract remains otherwise valid. Instead of the invalid clause, the statutory provisions apply (§ 306 BGB).
